Terms of Service

1. Acceptance

By creating an account or using Backnix services you agree to these terms. If you use Backnix on behalf of an organization, you confirm you are authorized to accept them for that organization.

2. Services and availability

Backnix provides cloud backup software and storage. Capabilities are labeled as available, beta or coming soon. Beta features may change and should be tested before you rely on them. Features marked as coming soon are not part of the contracted service until released.

3. Accounts

You are responsible for the confidentiality of your credentials and for activity in your account. Notify us immediately of any unauthorized use.

4. Plans, billing and renewals

Plans are priced by storage capacity in the currency selected at contracting. Monthly plans renew every month at the full price. Yearly plans are paid in advance; when a first-year promotion applies, it covers only the first annual cycle and renewals are charged at the full yearly price shown before contracting. Promotions are not reapplied automatically.

5. Customer responsibilities

You are responsible for choosing what to back up, configuring retention, protecting your encryption keys and periodically testing restores. Backnix cannot recover data encrypted with keys you have lost.

6. Acceptable use

You may not use Backnix to store unlawful content, to attack other systems, or in any way that harms the service or other customers.

7. Limitation of liability

To the extent permitted by law, Backnix is not liable for indirect or consequential damages. Specific service levels, if any, will be described in the plan or contract.

8. Termination

You may cancel at any time. After cancellation, stored data may be deleted after a notice period described in the plan.

9. Governing law

The governing law and jurisdiction will be defined in the final version of these terms after legal review.
